Disclaimer
Though prepared with great care, information shown in the Beach2Bush Kenya web page is for reference purposes only. We do not accept any liabilities for any changes, errors or omissions nor for
any resultant or consequential charges or liabilities incurred by any organization or individual.
Booking Terms and Conditions
1.) Once you have confirmation of your safari dates, a deposit of 30% is required. Safari dates and guides cannot be reserved without doing this and the first party to send a deposit covering
certain dates will secure them.
2.) Three quarters of the deposit amount is immediately refundable with at least 6 months notice of cancellation (with the balance charged by us as handling fee). When notice is received less
than six months prior to the scheduled safari departure date, the deposit will be retained as a cancellation fee.
3.) Changes can usually be made to safari dates provided personnel and facilities remain available, but if a safari is postponed six months prior to its starting date, the deposit cannot be
refunded later under any circumstances. Postponement is usually limited to six months.
4.) The balance for the safari should be paid one month before the safari starts and, once received is not refundable.
Liability
Although every possible care is taken to safeguard you and your property, we accept no liability to clients for any accidents, injuries or illness incurred or arising from any safari outfitted by
ourselves, or for loss or damage to client’s property during such a safari. While every effort is made to maintain equipment in first class condition, the company cannot undertake to immediately
replace any item that might malfunction in the course of a safari.
Risks
1.) Beach2Bush draws your attention to the fact that there are certain inherent risks involved in travel. You will be required to sign a release form to acknowledge this warning and also to
release and hold harmless Beach2Bush from any damages that may result.
2.) Although we will try to advise and help you whenever possible, it is your sole responsibility to take all appropriate medical advice prior to departure as to whether or not you are fit enough
to undertake the safari booked. Beach2Bush shall not be liable for any illness, injury or death sustained on safari sold by Beach2Bush, which is not due to the gross negligence of Beach2Bush, its
officers, employees, authorized representatives or agents whomsoever.
Force Majeure
1.) “Force Majeure” means, in relation to Beach2Bush, any circumstances beyond the reasonable control of Beach2Bush (including, but without limitation, acts of God, explosion, flood, tempest,
fire or accident, war or threat of war, sabotage, insurrection, civil disturbance, or requisition, sickness, quarantine, government intervention, weather conditions or other untoward
occurrences).
2.) If Beach2Bush is affected by Force Majeure it shall forthwith notify you and extend thereof.
3.) Beach2Bush shall not be deemed to be in breach of these terms and conditions or otherwise be liable to you, by reason of delay in performance or by non-performance, of any of its obligations
hereunder to the extent that any such delay or non-performance is due to any Force Majeure.
4.) If Beach2Bush is affected by Force Majeure it shall be entitled to and may in its sole and absolute discretion, vary or cancel any itinerary or arrangement in relation to the trip. Payment of
any refund by Beach2Bush to you as a result of the non-performance of any of the obligations of Beach2Bush hereunder shall remain in its sole and absolute discretion.
5.) Regarding civil unrest, once Beach2Bush has investigated the prevailing situation as it deems fit, it shall remain in the sole discretion of Beach2Bush, whether to proceed with the safari.
You may in such circumstances cancel the safari. However, if, after having made all the reasonable and proper inquiries, Beach2Bush is of the opinion that the safari may proceed, no refund will
be payable to you.
Insurance
Beach2Bush recommends that you consider the following types of insurance, which are commercially available in your country: Emergency Medical Evacuation, Major Medical, Accidental Death and
Disability, Loss of Personal Effects.
Exchange Rates
Rates used in the Safaris are based on tariffs and exchange rates valid at the time of advertising safaris. Because of possible fluctuations in exchange rate, Beach2Bush reserves the right to
recalculate the safari cost, based on the exchange rate. Any refund made by Beach2Bush shall be in its absolute and sole discretion.
Terms and Conditions
These terms and conditions govern the relationship between Beach2Bush and you. To the total exclusion of any other terms and conditions. No alternations to the terms and conditions may be made by
any unauthorized employee of Beach2Bush, authorized representatives or agents, unless in writing of an authorized employee of Beach2Bush. All decisions and matters subject to the discretion of
Beach2Bush shall be made by an authorized officer or employee of Beach2Bush.
Carriage by Land, Sea and Air
1.) Carriage by land, sea and air is subject to the terms and conditions of the carrier with whom you travel and to international conventions some which may limit liability. Land, sea and air
travel are also subject to operational decisions of carriers and sea ports which may result in cancellations, delays or diversions, over which Beach2Bush has no control and for which Beach2Bush
accepts no liability whatsoever.
2.) The passenger contract in use by the airline carriers concerned, when issued, shall constitute the sole contract between the transportation companies and the purchaser of these programs and /
or the passengers.
Baggage
Temporary or permanent loss of baggage is the responsibility of you or the carrier, not Beach2Bush.
Travel Documents and Vaccinations
It is your responsibility to ensure that passport, visas, travel permits, heath certificates, inoculations, international driving license or other documentation required for the trip are obtained
and are in order. It is your responsibility to meet any additional costs incurred by yourself or by Beach2Bush on your behalf as a result of any failure by you to comply with such requirements.
Anti-malarial precautions should be commenced prior to departure. Please consult your physician for more details.
Special Requests
You must advise Beach2Bush of any special requests, i.e. diet, facility or physical handicap, when you submit your reservation request to Beach2Bush, which will be met if possible.
Information in Brochures / Electronic Advertisements
All information given in any brochure or otherwise advertised, (including electronic advertisements on the Internet) is, to the best of Beach2Bush’s knowledge, correct but Beach2Bush reserves the
right to change same. The photographs reproduced and information provided depict typical scenes experienced and details on each destination; but the subject matter may not necessarily be seen or
experienced while visiting that destination.
Photography
Beach2Bush reserves the right without further notice to make use of any photography or film taken on this safari by any staff member, safari guide or operator for general purposes without payment
or permission.
Disputes
If you have any cause for complaint while on safari, you must immediately bring it to the attention of your guide who will attempt to resolve the situation. Beach2Bush has the right to disregard
any disputes brought to its attention after the completion of the safari.
Consent
The payment of the advance payment or any partial payment for reservation on a safari constitutes consent to all provisions of the conditions and general information contained in any brochure
(electronic or otherwise), invoice and travel documents. The terms under which you agree to take these safaris cannot be changed or amended.
Condition of Booking
You shall comply with instructions of any representative of Beach2Bush, safari guide or local ground operator at all times. No client shall be accepted or be permitted to continue on a safari
while their status or mental or physical condition is, in the opinion of any representative of Beach2Bush, safari guide or local ground operator, such as to render them incapable of caring for
themselves or other safari clients and Beach2Bush will not be responsible for expenses by such persons precluded from completing the safari for this reason.
Notice of Enforceability
Please remember, when you book travel related services with Beach2Bush, you are entering into a binding agreement where all terms and conditions are fully understood as stated in this document.
